She has been accused of falsely stating in public documents that her main home is in Norfolk, Virginia, while she also owns a property in Brooklyn. The allegations suggest that she purchased the Virginia home with her niece after taking office, raising questions about her compliance with New York’s residency requirements for elected officials.

In August 2023, James signed a document declaring her intention to make the Virginia property her principal residence. However, neighbors reportedly have never seen her at that location. A federal criminal referral has been made, citing these discrepancies. Additionally, James is accused of misrepresenting the number of apartments in a Brooklyn building she owns, which could have implications for mortgage eligibility.
