Kim Kardashian Mistakenly Labeled Him a Texas Death Row Inmate on Instagram—Now He’s Suing

Kim Kardashian is facing a lawsuit from a New York resident, Ivan Cantu, who claims that an Instagram post made by the celebrity caused him significant emotional distress. The incident dates back to February, when Kardashian shared a photo of Cantu, mistakenly identifying him as a death row inmate in Texas who was scheduled for execution just two days later. Cantu, who lives in Westchester, New York, asserts that he has never been convicted of any crime, let alone double murder, and is now seeking legal recourse for defamation.

The Instagram post, which garnered attention from Kardashian’s massive following of over 350 million users, included an unauthorized image of Cantu along with a call to action urging followers to sign a petition against the execution of the actual inmate, who shares Cantu’s name. The real Ivan Cantu was executed by lethal injection shortly after Kardashian’s post, having been convicted in 2000 for the murders of his cousin and the cousin’s fiancée. He maintained his innocence until his death.

Cantu’s lawsuit, which has not yet been officially filed but was submitted as a civil complaint to the Los Angeles Superior Court, alleges that Kardashian’s actions have caused him severe mental and emotional trauma. He claims to have suffered from anxiety, nightmares, and other psychological issues as a result of the erroneous identification.

Kardashian’s legal representative, Michael Rhodes, has characterized the situation as a “simple mistake” stemming from the use of a public photo of another individual with the same name. He emphasized Kardashian’s commitment to criminal justice reform, stating that the post was intended to promote awareness of the issue rather than to harm anyone. Rhodes also noted that the post was promptly removed once the mistake was recognized.

Despite the removal of the post, Cantu argues that the damage to his reputation has already been done, exposing him to public scorn and ridicule. His complaint accuses Kardashian of libel, slander, and negligence, claiming her actions were intentional and reckless. He is pursuing both compensatory and punitive damages, with the exact amount to be determined in court.

Kardashian, who has been involved in criminal justice advocacy since 2017, previously gained attention for her efforts to secure clemency for individuals facing harsh sentences. This latest incident, however, highlights the potential consequences of public figures sharing information without proper verification, raising questions about the responsibilities that come with their platforms.
