Sheriff Robert Luna has taken legal action against the Los Angeles County Civilian Oversight Commission. The lawsuit, filed in L.A. County Superior Court, seeks a court’s guidance on whether the Sheriff’s Department must comply with subpoenas issued by the commission. These subpoenas request records related to incidents of deputy misconduct, including violent encounters with citizens.
The commission’s subpoenas target three controversial cases involving deputies who have faced serious allegations, including excessive force and criminal behavior. In some instances, the deputies involved have been fired, barred from law enforcement, or have pleaded guilty to federal charges.
The Sheriff’s Department was expected to respond to the subpoenas shortly after the lawsuit was filed. However, Sheriff Luna expressed uncertainty about whether state laws, which keep most police personnel records confidential, would conflict with the commission’s legal authority to demand these records.
The oversight commission, which was empowered by voters in 2020 through Measure R, has been increasingly assertive in its requests for transparency from the Sheriff’s Department. This includes the right to subpoena records and witnesses.
Luna’s lawsuit claims that without judicial clarification, the department may face potential criminal charges or civil liability for complying with the subpoenas. The Sheriff’s Department has previously resisted some commission requests, citing confidentiality laws, while complying with others.
Robert Bonner, the commission’s chair and a former federal judge, expressed disappointment over the sheriff’s decision to sue. He noted that the lawsuit comes just as the department was due to respond to subpoenas seeking information on the use of force against citizens.
The oversight commission has a history of issuing subpoenas to the Sheriff’s Department, particularly in light of past scandals and allegations of misconduct. The current legal dispute highlights ongoing tensions between the Sheriff’s Department and oversight officials as they navigate issues of accountability and transparency in law enforcement.
